The American Civil Liberties Union of New Jersey and Garden State Equality, represented by the Lowenstein Center for the Public Interest, filed amicus briefs in support of cases to enforce the New Jersey Law Against Discrimination brought by the New Jersey Attorney General against three Monmouth County school districts. The districts adopted policies requiring school staff to out transgender students to their parents or guardians and were temporarily halted by a trial court judge. The briefs explain that the United States and New Jersey Constitutions do not compel schools to notify parents over the objection of their children about their children’s gender expression. The briefs document the physical, mental health, and educational harms that forced outing policies will have on transgender students and schools and explain that implementing the policies would raise serious constitutional questions about students’ rights to equal protection of the law.
